At this point, it should just be expected that fan-made games using Nintendo’s IP will inevitably be hit with a DMCA takedown claim. In the past month alone, the company has taken down Another Metroid 2 Remake, Pokémon Uranium Versionand a large number of titles on Game Jolt.
The latest title to get the attention of Nintendo’s legal team is No Mario’s Skyby ASMB Games, an obvious nod to both No Man’s Skyand the Super Mario Bros.franchise. No Mario’s Sky, which was developed as part of the Ludum Dare 36 game coding competition, combined traditional 2D platforming with procedurally-generated space exploration.
Not to let the effort put into No Mario’s Sky go to waste, the developers made several adjustments to their game and re-uploaded it to itch.ioas DMCA’s Sky. Such changes include replacing coins with green gems, replacing Princess Peach with a character by the name of Princess Mango and tweaking several of the game’s character sprites.
Whether or not these modifications are enough to satiate Nintendo’s legal department remains to be seen, but it is interesting to see a development team transform a fan game into a passive-aggressive jab at the company that tried to take it down.
